What you agree to when you use our website, buy products, or book workshops.

Welcome to Little Engineers. These Terms & Conditions explain how you may use our website and how we supply products and services through it.

By accessing or using this website, or by placing an order with us, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the site.

In these Terms:

  • “we”, “us”, “our” means Little Engineers
  • “you” means the person using our website or purchasing from us
  • “site” means https://www.littleengineers.co.nz and any related pages

These Terms apply in addition to any rights you have under New Zealand law, including the Consumer Guarantees Act 1993 (CGA) and Fair Trading Act 1986 (FTA). Nothing in these Terms is intended to limit or exclude those rights where they apply.


1. Using our website

1.1 You agree to use our site only for lawful purposes and in a way that does not infringe the rights of, restrict or inhibit anyone else’s use of the site.

1.2 You must not:

  • attempt to gain unauthorised access to our site, servers or data
  • introduce viruses or other harmful code
  • scrape, copy or harvest data from the site in bulk
  • use our site in any way that is fraudulent or misleading.

1.3 We may suspend or restrict access to all or part of the site at any time if we reasonably believe you have breached these Terms or for maintenance and updates.


2. Information on this site

2.1 We try to ensure the information on our site is accurate and up to date, but mistakes can happen and information may change over time.

2.2 Product details (including descriptions, images and specifications) are for general information and teaching guidance only. Actual colours, packaging or components may vary slightly from the images shown.

2.3 Nothing on this site is engineering, technical or professional advice. It is educational in nature and should be used with appropriate teacher or adult supervision.


3. Accounts and passwords

3.1 You may create an account to make ordering easier and view past orders. You are responsible for keeping your login details secure and for all activity under your account.

3.2 Please:

  • choose a strong password
  • keep it private
  • let us know promptly if you believe your account has been accessed without your permission.

3.3 We may suspend or close your account if we reasonably believe it is being misused or compromised.


4. Who can place orders

4.1 Our site is primarily intended for schools, educators and parents/caregivers in New Zealand.

4.2 To place an order on this site you must:

  • be at least 18 years old, or
  • have the permission and supervision of a parent, caregiver or authorised school representative.

4.3 By placing an order, you confirm that all information you provide is accurate and that you are authorised to use the payment method you select.


5. Ordering products

5.1 When you place an order, you are making an offer to buy the products in your cart. We accept your order when we send you an order confirmation email.

5.2 We may decline or cancel an order (for example, if a product is out of stock, there is a pricing or description error, or we have concerns about payment or misuse). If we cancel an order after payment, we will refund you in full.

5.3 Please review your order carefully before confirming it. If you need to update an order after placing it, contact us as soon as possible. We cannot guarantee changes once processing or shipping has begun.


6. Pricing, GST and currency

6.1 All prices on the site are shown in New Zealand dollars (NZD).

6.2 Unless we clearly state otherwise, prices are inclusive of GST but exclusive of shipping. Shipping costs (if any) are shown at checkout before you complete your purchase.

6.3 We may change prices or run promotions from time to time. The price you pay is the price shown at checkout when you place your order.


7. Payment

7.1 We accept the payment methods listed at checkout (for example, debit/credit card or other payment services). These may be provided by third-party processors.

7.2 Payment is generally taken at the time you place your order, unless we have agreed another arrangement with you (for example, an invoice for a school).

7.3 If your payment fails, is reversed or is later charged back, we may cancel your order and/or require you to pay any costs we reasonably incur as a result.


8. Shipping and delivery

8.1 We currently ship mainly within New Zealand. If you are outside New Zealand and would like to order, please contact us to discuss options.

8.2 Shipping methods, timeframes and costs are displayed at checkout. Any timeframe is an estimate only. Actual delivery times may be affected by courier delays, public holidays, or factors outside our control.

8.3 Risk in the products passes to you when they are delivered to the address you provide. Please make sure your delivery details are accurate.

8.4 If a parcel is returned to us because the address was incomplete or incorrect, or it was not collected, we may charge you for re-delivery.


9. Returns and refunds

9.1 Faulty, damaged or not as described

If a product is faulty, damaged on arrival, or not as described:

  • contact us as soon as reasonably possible after you notice the issue
  • include your order number, a description of the problem, and photos if you can.

Once we have assessed the issue, we will meet our obligations under New Zealand law, which may include repair, replacement or a refund, depending on the circumstances.

Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 or Fair Trading Act 1986 where they apply.


9.2 Incorrect or missing items

If you receive the wrong product, or something is missing from your order:

  • contact us promptly with your order details and a description of what is incorrect or missing
  • we will arrange to supply the missing item or replace the incorrect item, or provide another appropriate remedy.

9.3 Change of mind

We are not required to accept returns where you change your mind or decide you no longer want the product.

In some cases, we may agree at our discretion to accept a change-of-mind return if all of the following are true:

  • you contact us within 14 days of receiving the product
  • the product is unused, in original condition, and in its original, undamaged packaging
  • you provide proof of purchase (for example, your order confirmation or invoice).

If we agree to a change-of-mind return:

  • you must return the product to us at your own cost using a tracked service
  • you are responsible for the product until it is received by us
  • once we receive and inspect the returned product, we will refund only the product price
  • shipping costs are not refunded for change-of-mind returns.

We may refuse a change-of-mind return if the product has been used, damaged, or is not in resaleable condition.


10. Warranty and consumer guarantees

10.1 Our standard warranty

  1. We stand behind the quality of the kits and physical products we supply.
  2. In addition to your rights under the Consumer Guarantees Act 1993 (CGA), we provide a 12-month warranty against manufacturing defects on the physical products we sell, including items supplied as part of a kit (for example, the multimeter included with our Electricity & Magnetism kit).
  3. This warranty applies where products are used, stored, and maintained in line with our instructions and for their intended educational purpose.

10.2 What our warranty covers

Subject to the exclusions below, our warranty covers:

  1. Manufacturing faults in materials or workmanship that mean the product is not of acceptable quality or fails earlier than a reasonable person would expect in normal educational use.
  2. Defective components supplied as part of a kit, including third-party components such as the multimeter in the Electricity & Magnetism kit, provided they were supplied by us and used as intended.
  3. Replacement or repair, at our discretion, of the affected product or component, or a refund where repair or replacement is not practical.

This warranty applies to products purchased directly from Little Engineers (including via our website or authorised channels).

10.3 What our warranty does not cover

Our warranty does not cover:

  1. Damage caused by misuse or unauthorised modification, including:
    • Use outside the recommended voltage, current, or load
    • Connecting components in ways that contradict our instructions
    • Opening, dismantling, or modifying components not intended to be user-serviceable
  2. Damage caused by incorrect storage or handling, such as moisture damage, extreme heat, impact, or corrosion.
  3. Normal wear and tear consistent with regular classroom use (for example, cosmetic scuffs, worn leads, or minor marking).
  4. Consumables, such as batteries, unless they are faulty at the time of supply.
  5. Products not supplied by us, or third-party products purchased from another retailer, even if they are similar to those used in our kits.
  6. Losses that are indirect or consequential, such as lost teaching time or lost data.

Your rights under the CGA may still apply even if an issue falls outside our voluntary warranty, depending on the circumstances.

10.4 How to make a warranty claim

If you believe a product is faulty:

  1. Contact us as soon as reasonably possible after you notice the issue, with:
    • Your order number or proof of purchase
    • A description of the fault
    • Clear photos or short video showing the issue, where possible
  2. We may ask you to perform simple checks or tests so we can understand the fault.
  3. We may ask you to return the product for inspection. If the product is found to have a manufacturing defect covered by this warranty, we will cover reasonable return shipping costs.

If the product is confirmed to be faulty under this warranty, we will:

  • Repair the product, or
  • Replace it with the same or a similar item, or
  • Provide a refund, where repair or replacement is not practical.

10.5 How this interacts with the Consumer Guarantees Act (CGA)

  1. If you are purchasing for personal, domestic, or household use, nothing in these Terms or in this warranty limits your rights under the Consumer Guarantees Act 1993.
  2. The 12-month warranty period does not replace or reduce the “reasonable time” that goods are expected to last under the CGA. In some cases, your CGA rights may apply for longer than 12 months.
  3. For business customers acquiring goods or services for the purposes of a business, we may agree in writing that the CGA does not apply to the extent permitted by law.

11. Workshops and events

10.1 We may offer workshops, camps, school sessions or other in-person or online events (collectively “workshops”).

10.2 Additional details such as dates, content, pricing and any specific terms or waivers may be provided at the time you book. Those will apply in addition to these Terms.

10.3 For workshops involving students or children, we may require:

  • consent from a parent/caregiver or school representative, and
  • compliance with safety instructions and codes of conduct that we provide.

10.4 We reserve the right to refuse or cancel a workshop booking (for example, if minimum numbers are not met, a venue becomes unavailable, or there are safety concerns). If we cancel a workshop, we will normally offer a refund or transfer to another date.

10.5 Participants must follow all safety guidance from our team and take reasonable care when using tools, electronics or equipment. Where students are present, teachers or supervising adults are responsible for their supervision in accordance with school or venue policies.


12. Your rights under New Zealand law

11.1 If you are a consumer (buying for personal, domestic or household use), you have non-excludable rights under the Consumer Guarantees Act 1993 and Fair Trading Act 1986. Nothing in these Terms is intended to exclude or limit those rights.

11.2 If you are purchasing as a business (for example, a school, organisation or company), you agree that the statutory guarantees under the Consumer Guarantees Act do not apply to the extent permitted by law. This clause does not affect any rights you may have under the Fair Trading Act that cannot be contracted out of.


13. Limitation of liability

12.1 To the maximum extent permitted by New Zealand law, and except as set out in these Terms or required by the CGA/FTA:

  • we are not liable for any indirect, special or consequential loss, or loss of profits, revenue, data, or goodwill; and
  • our total combined liability to you for all claims relating to any order or use of the site will not exceed the amount you paid us for the relevant product or service.

12.2 You are responsible for deciding whether our products and workshops are suitable for your class, school or child, including any specific learning needs or health and safety requirements.

12.3 You agree to follow all safety instructions that come with our products and any additional guidance we provide on the site or at workshops.


14. Intellectual property

13.1 All content on this site—including text, graphics, logos, icons, images, photos, videos, workshop materials and code—is owned by us or our licensors and is protected by copyright and other intellectual property laws.

13.2 You may:

  • view the site in a web browser
  • print or download content for your own classroom or personal educational use (non-commercial), provided you keep all copyright notices and do not change the content.

13.3 You must not, without our written permission:

  • copy large portions of the site
  • republish or redistribute content for commercial purposes
  • reverse engineer or reuse product designs and materials in a way that competes with us.

15. User content (reviews, photos, feedback)

14.1 If you submit reviews, comments, testimonials, photos or other content (“user content”) to us or through the site:

  • you promise that you own or have the right to share that content; and
  • you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, adapt and display that content in connection with our business (for example, on the site or in marketing materials).

14.2 We may moderate, edit or remove user content that we reasonably consider to be inappropriate, misleading, offensive or unlawful.


16. Privacy and cookies

15.1 Our Privacy Policy explains how we collect, use, store and protect your personal information, as well as your rights under the New Zealand Privacy Act 2020.

15.2 By using this site or providing personal information to us, you agree that we may handle your information in accordance with our Privacy Policy.

15.3 Our site may use cookies and similar technologies. You can find more detail in the Privacy Policy and your browser settings.


17. Third-party links and services

16.1 Our site may link to other websites or use third-party services (for example, payment processors, email providers or content delivery networks).

16.2 These third-party sites and services are not under our control. We are not responsible for their content, policies or practices. You should review their terms and privacy policies where relevant.


18. Changes to these Terms

17.1 We may update these Terms from time to time, for example to reflect changes in our products, services or the law.

17.2 When we make significant changes, we will update the “Last updated” date at the top of this page. Your continued use of the site after any changes means you accept the updated Terms.


19. Suspension or termination

18.1 We may suspend or terminate your access to the site, or cancel an order, if we reasonably believe you:

  • have breached these Terms
  • are using the site in a fraudulent or harmful way
  • are attempting to interfere with the security or proper functioning of the site.

18.2 If we terminate access without cause (for example, if we close the site), this will not affect any orders we have already accepted, and we will still honour our obligations in relation to those orders or refund you where appropriate.


20. Governing law

19.1 These Terms are governed by the laws of New Zealand.

19.2 You and we submit to the non-exclusive jurisdiction of the New Zealand courts in relation to any disputes arising out of or in connection with these Terms or your use of the site.
